Judge Peter Flynn entered an order today dismissing all claims against the president, officer and shareholder of iMenu360 Inc. with prejudice. The plaintiffs filed a derivative action asking the Court to force iMenu’s president to sell his shares of stock under the “high noon” provisions of the company’s operating agreement and to effectively turn over his ownership interest in the company.

Through a series of strategic moves, including moving for summary judgment prior to the issuance of any discovery, firm attorneys were able to have the key issue of the case resolved against the plaintiffs, and the case was dismissed.
